Police: Woman With 5 Kids in Car Among Those Arrested at Sobriety Checkpoint

Four others also arrested at checkpoint Sunday night, police say.

A Shirley woman with five young children in her car was among five people arrested at a sobriety checkpoint in Shirley Sunday night, police said. 

Police officers from the Suffolk County Highway Patrol Selective Alcohol Fatality Enforcement Team (SAFE-T), assisted by the Suffolk County Parks Police conducted the checkpoint from 8:30 p.m. to 10:40 p.m. on the William Floyd Parkway at Smith Point County Park. 

Elba Ayala, 43, was driving a 2010 Nissan Altima when she attempted to drive through the checkpoint without stopping, police said.

Officers were able to pull the vehicle over and determined that Ayala was intoxicated, police said.

Another adult woman and five children, ages seven months to eight years old, were also in Ayala's vehicle, police said. 

Ayala was arrested and charged with DWI with a child passenger 15 years old or younger–a felony under Leandra's Law, DWI and five counts of endangering the welfare of a child. 

A total of 1,077 vehicles went through the checkpoint, which was conducted to help prevent injuries and fatalities associated with driving while intoxicated, particularly during the holiday weekend, police said.  

The following people were also arrested at the checkpoint and charged with DWI:

  • Robert Downs, 57, of Center Moriches
  • Jonathon Rettig, 38, of East Patchogue
  • Yaneth Rojas-Zuniga, 23, of Shirley
  • Vivian St. Clair, 62, of Shirley

All of those arrested are scheduled to be arraigned Monday at First District Court in Central Islip.
